Copyright Registration

Registering books, software, logos, artwork, music and films with the Copyright Office, for creators and businesses in Ranchi and across Jharkhand.

Why register copyright

Copyright arises automatically when an original work is created. Registration is not compulsory, but an entry in the Register of Copyrights is prima facie evidence of the particulars recorded (Section 48, Copyright Act, 1957). In a dispute, this makes it much easier to prove authorship and the date of creation.

Works that can be registered

  • Literary works: books, articles, reports, website content, and computer programs and source code
  • Artistic works: logos, labels, drawings, paintings, photographs, architectural drawings
  • Musical works and sound recordings
  • Cinematograph films and video content

Registration process

  1. Filing Form XIVThe application is filed online with the Copyright Office with a copy of the work and the required statements. A diary number is issued.
  2. 30-day objection periodUnder the Copyright Rules, 2013, a mandatory 30-day period follows during which any person may object.
  3. ExaminationIf there is no objection, an examiner reviews the application. Any discrepancy letter must be answered within the time given.
  4. Hearing, if there is an objectionThe Registrar hears both sides before deciding.
  5. Entry in the RegisterThe work is entered in the Register of Copyrights and the extract is issued.

Special cases

Logos

A logo can be protected both as a trade mark and as an artistic work. For copyright registration of an artistic work used on goods or services, the Copyright Act requires a statement from the Trade Marks Registry that no identical or deceptively similar mark is registered or applied for. We obtain this as part of the process.

Software

Software is registered as a literary work. The application includes extracts of the source code in the form the Copyright Office requires, so the full code does not need to be disclosed.

How long it takes

A clean application with no objection or discrepancy commonly takes two to three months. Discrepancy letters and objections add time.

Frequently asked questions

Is copyright registration compulsory in India?

No. Copyright exists from creation. Registration is optional but gives prima facie evidence of authorship and ownership, which helps in any dispute.

Should I register my logo under copyright or trade mark?

Ideally both. Trade mark registration protects the logo as a brand identifier for your goods or services. Copyright protects the artwork itself.

Who owns the copyright in work made by an employee or a freelancer?

Work made by an employee in the course of employment generally belongs to the employer. Work made by a freelancer belongs to the freelancer unless there is a written assignment, so a written agreement is important.

How long does copyright last?

For literary, dramatic, musical and artistic works, generally the lifetime of the author plus sixty years. For films and sound recordings, sixty years from publication.
